  • Motor Vehicle Accident Compensation

    Motor Vehicle Accident Compensation

    The third party insurer in Western Australia is the Insurance Commission of Western Australia which is an insurance incorporated into the motor vehicle licence of every West Australian registered motor vehicle. This means that if you are a passenger, driver, cyclist, motorcyclist, pedestrian and sustain injuries as a result of a motor vehicle accident through no fault (either entirely or partially) of your own then you may be eligible to make a claim for compensation for the injuries you sustained.

    If you or someone you know has sustained injuries as a result of a motor vehicle accident then the injured person may be eligible to claim for compensation such as:

    • Damages for Pain and Suffering
    • Loss of Amenities
    • Loss of Enjoyment of Life
    • Economic Loss i.e. loss of wages both past and future
    • Medical/Treatment expenses calculated at the prescribed rates
    • Gratuitous/Paid Assistance
    • Travelling Expenses

    The processes involved after a motor vehicle accident is generally overwhelming. It is therefore important that any injured person understands what to do after a motor vehicle accident, the processes involved with their claim and to understand their claim generally. At ilberys we can offer you that assistance at any stage of your claim.

    As at 15 November 2005, the limitation period is 3 years. This means that if a person sustains injuries as a result of a motor vehicle accident, the claim may become statute barred after 3 years from the date of accident. It is therefore essential that a person either commences legal proceedings or attains settlement of the matter prior to the expiration of the 3 year period.

    n Western Australia, a worker may be eligible to make a claim for compensation if they sustained injuries in the course, or arising out of, their employment. Upon acceptance of liability of the claim, pursuant to the Workers' Compensation and Injury Management Act 1981, a claimant may be eligible for:

    • Loss of Earnings
    • Medical/Treatment Expenses
    • Rehabilitation Expenses
    • Travelling Expenses
    • Lump sum payment for Permanent Impairment

    Our legal team are experienced with all stages of the workers' compensation process including, but not limited to:

    • Providing advice with respect to potential common law claims for negligence
    • Where liability for the claim is disputed or denied, commencing and representing Applicants at the Dispute Resolution Directorate of WorkCover WA
    • Where there is a dispute concerning a claim for loss of earnings (also referred to as weekly payments) and medical expenses (for example, seeking an extension of weekly payments or medical expenses)
